La protection internationale des droits de l’homme, une garantie pour les Ecossais dans le contexte politique britannique ?
Selon le Scotland Act de 1998, loi portant création des institutions écossaises, les lois et règlements pris par les autorités écossaises doivent être compatibles avec la Convention européenne des droits de l’homme. Après 2010, avec le retour au pouvoir des Conservateurs sur le plan britannique, parmi lesquels des députés et des ministres désireux de s’affranchir de ce texte, ou du moins du Human Rights Act, une majorité d’élus écossais a réaffirmé son attachement à cette protection des droits de l’homme, par des discours et par des décisions. Ils ont ainsi accordé le droit de vote aux détenus pour de courtes peines, alors que l’interdiction dans le reste de la Grande Bretagne avait fait l’objet de plusieurs condamnations du Conseil de l’Europe.
De plus, les députés au Parlement écossais ont également cherché à incorporer dans leur droit positif des conventions internationales, en particulier la Convention internationale des Droits de l’Enfant. La loi n’a pourtant jamais été promulguée, la Cour Suprême, saisie par le gouvernement britannique, ayant partiellement invalidé un texte qui empiétait sur le domaine réservé. Les élus écossais, en particulier les indépendantistes, se sont indignés de ces contraintes britanniques, tandis que le gouvernement écossais est à la recherche d’une solution juridique appropriée.
L’objectif de cette communication est de mettre en évidence, à partir de l’analyse de sources primaires, un discours politique écossais qui, au-delà des seuls indépendantistes, tend à percevoir la protection internationale des droits de l’homme comme une garantie pour les Ecossais dans le cadre du Royaume-Uni.

Increasing the international supply of workers post Brexit and the impact on the health sector
The shortfall in staff in the public health sector has become an increasing area of concern in recent years in the UK. The British Medical Association (BMA) reported that there were 124 000 unfilled vacancies in secondary care in June 2022 in England. The loss of EU staff following Brexit and new requirements for workers from EU countries have pushed NHS trusts to recruit overseas. Currently 34% NHS doctors come from outside the UK, with a steady increase each year since the UK left the European Union. However, concerns exist over the viability of this recruitment in the long term and the impact on both the health system in Britain but also overseas, especially for those recruited from low income developing countries. This paper will thus consider the challenges of the NHS’s international recruitment policy and provide specific case studies to illustrate the significant issues arising from this transnational policy.

The revival of the Entente Cordiale: Transcending borders and national sovereignty
As Thomas Otte, a historian of British foreign policy, pointed out: “memories of the 1904 entente will always frame discussions of contemporary Anglo-French relations”[1]. Professor Otte alludes to the mutual understanding reached on April 8th,1904 between Britain and France, two countries deeply attached to their national sovereignty and identity fuelled by their respective sense of exceptionalism. Although they had confronted each other in multiple conflicts culminating in the Napoleonic wars, they became allies at strategic times. The Entente Cordiale as it came to be known would prove critical not only for the relations between the two countries but also for transnational governance. Thus, on June 16th, 1940 Britain and France came close to merging their national governments into one based on common institutions and a common citizenship faced with a common enemy, Germany. This “Franco-British Union” intended this time to be permanent as “a perpetual association” between the two countries, transcending their national borders and sovereignties. Andrea Bosco, an expert in Europe and Federalism, argues that this federalist project, supported by both Jean Monnet and Winston Churchill, was already “an attempt to build a European Union”[2].
Neither an alliance nor a treaty, the Entente Cordiale started as an informal agreement between two colonial countries over their respective territorial possessions in Egypt and Morocco to delineate their respective areas of influence. It paved the way for a naval formal agreement in 1912, then an effective alliance which withstood two world wars and many other tensions lately including Brexit as well as contemporary regional wars. Britain’s departure from the European Union at the end of January 2020 led to an important level of strain between the two countries even if they succeeded in maintaining key bilateral cooperation notably in terms of defence and justice, including liaison judges in their respective embassies. They experienced a form of détente more recently facilitated by the good personal relationship between the British Prime Minister, Rishi Sunak, and the French President, Emmanuel Macron. Significantly, the United Kingdom is due to host the fourth meeting of the European Political Community (EPC) in 2024. This could be seen as a revival of the Entente Cordiale and beyond, the sign of a working, more serene partnership between the United Kingdom and continental Europe, as Great Britain remains part of Europe.

Le rôle des associations et des institutions transnationales dans la redéfinition de la notion de souveraineté et des politiques d’immigration : le cas du Territoire britannique de l’Océan indien
Le Territoire britannique de l’Océan indien (TBOC) ou l’Archipel des Chagos fait l’objet d’une dispute territoriale entre le Royaume-Uni et l’île Maurice depuis les années 1980. L’Archipel des Chagos a été détaché des dépendances de l’île Maurice lors de son accession à l’indépendance du Royaume-Uni, pour former le TBOC. Les Chagossiens, ex-habitants de l’Archipel des Chagos ont été expulsés vers l’île Maurice et les Seychelles pour la construction d’une base militaire américaine dans les années 1970. Les Chagossiens, actuellement dispersés dans plusieurs pays, y compris le Royaume-Uni, demandent le droit de retour dans l’Archipel, un droit refusé jusqu’à ce jour. L’île Maurice continue à réclamer sa souveraineté sur l’Archipel des Chagos.
Le 25 février 2019, la Cour internationale de justice, organe juridique de l’Organisation des Nations Unies, a rendu un avis consultatif dans ce litige stipulant que : « le Royaume-Uni est tenu, dans les plus brefs délais, de mettre fin à son administration de l’archipel des Chagos »[3]. Cet avis a suscité l’étonnement du Royaume-Uni, qui considère qu’il s’agit d’une affaire bilatérale entre deux États et que l’intervention de la Cour internationale de Justice est injustifiée. Le Royaume-Uni a finalement accepté de négocier les termes d’un accord sur la souveraineté de l’Archipel des Chagos avec l’État mauricien en 2023. Le contenu de ces négociations reste inconnu à ce jour.
Ce cas d’étude fait ressortir deux champs d’analyse, à savoir, l’aspect géopolitique et humain. En effet, l’Archipel des Chagos implique une dispute territoriale entre deux États et la réclamation des droits de l’homme et des droits des peuples par les Chagossiens en exil. Cette présentation s’attachera ainsi à soulever les problématiques transnationales autour de l’Archipel des Chagos et de son peuple. Il s’agit de traiter le rôle des associations culturelles (le Groupe Réfugiés Chagos), des associations environnementales (the Royal Zoological Society, the Chagos Conservation Trust), des institutions légales (la Cour Suprême de Londres, la Cour internationale de Justice) et des institutions culturelles (l’UNESCO) dans la redéfinition des notions de souveraineté dans le cas de l’Archipel des Chagos. L’influence de l’avis consultatif, bien que non-contraignant, émanant d’un organe juridique international, sur les législations nationales britanniques en matière d’immigration sera également traitée, notamment avec le Nationality and Borders Act 2022 qui permet de modifier le statut administratif des Chagossiens.

Réconcilier promotion des valeurs et affirmation de la souveraineté des Etats : le Commonwealth au défi des nouvelles frontières de la gouvernance transnationale
Le Commonwealth, après la publication du rapport des personnes éminentes en 2011 et la signature de sa charte en 2013 s’est donné pour ambition de réaffirmer ses valeurs et principes en se définissant officiellement comme étant au service du « peuple du Commonwealth ». Cependant, le Commonwealth est aussi défini comme une organisation d’Etats souverains et ces derniers demeurent les éléments clé dans la définition de ses priorités et de son action.
La question de la promotion des valeurs de l’organisation a été une source majeure de tension ces trente dernières années opposant Etats du Nord et Etats du sud, ces derniers accusant les premiers de néo-impérialisme. Le réinvestissement du Commonwealth par les gouvernements britanniques post-Brexit après 2016 et la sacralisation de la notion de souveraineté dans leur discours d’opposition à l’Union européenne, a changé le rapport de force et repositionné le débat sur la compatibilité entre promotion des valeurs et souveraineté au cœur du fonctionnement de l’organisation. D’un autre côté, il a également placé le gouvernement britannique lui-même face aux contradictions de son propre discours de politique étrangère, à la fois promoteur de principes considérés comme des valeurs universelles d’humanité commune mais bafouées par de nombreux Etats du Commonwealth, et chantre de la souveraineté étatique contre des organisations internationales jugées trop intrusives.
Dès lors cette communication propose de s’interroger sur la manière dont cette contradiction de la gouvernance transnationale a pu être surmontée. En effet, ces dix dernières années, on a assisté à la mise en place progressive et pragmatique d’une division du travail entre le « Commonwealth informel » des ONG et des sociétés civiles, attachés à mettre en œuvre les politiques visant à promouvoir concrètement les valeurs et principes du Commonwealth, et le Commonwealth inter-gouvernemental, celui des sommets des chefs de gouvernement et de la collaboration intergouvernementale où sont définies les grandes orientations diplomatiques du Commonwealth, et où prévaut la recherche et l’affichage de l’unité et du consensus entre les Etats, et l’affirmation de leur égalité. De la capacité de ces deux branches du Commonwealth à dialoguer et se prendre mutuellement en considération dépend désormais l’efficacité de la gouvernance transnationale de l’organisation, sa crédibilité et finalement sa pertinence pour la politique étrangère britannique.

London’s Chinatown: the Production of Diversity in a Diverse City
In the heart of a global city wrestling with the paradox of multiculturalism’s criticism, London’s Chinatown stands as a testament to ‘manufactured diversity’—a concept transcending mere demographic representation. This study unveils how London’s Chinatown is not simply a cluster of ethnic heritage but a strategic economic asset, intricately woven into the city’s fabric. Amidst the multifaceted interpretations of ‘diversity’ across urban design, planning, and sociology, Chinatown emerges as a unique blend of cultural symbolism and economic pragmatism.
The evolution of Chinatown illustrates a complex negotiation between perceived authenticity and economic objectives. Far from being a passive reflection of the Chinese diaspora’s experiences, the district’s identity is shaped by a synthesis of Western perceptions and market- driven imperatives. This dynamic culminates in the creation of a simulacrum: Chinatown as a space where the display of Chinese culture serves dual purposes of attracting tourism and reinforcing economic agendas, rather than solely preserving authentic ethnic heritage.
This socio-political exploration sheds light on the intricate ways in which global cities like London leverage multiculturalism amidst its growing critique. By dissecting the transformation of London’s Chinatown, this study reveals how urban spaces become arenas where cultural diversity is not only a societal attribute but a strategically deployed economic tool. This offers a critical perspective on the intersection of urban policy, economic strategy, and cultural identity in the face of global urban challenges.

Quôc-Dung DANG holds a doctorate in British politics from Sorbonne Nouvelle University. His research focuses particularly on the representation of ethnic minorities in urban spaces in the United Kingdom. His PhD dissertation was a comparative study of London’s Chinatown and the quartier asiatique de Paris, where he analysed the similarities and contrasts between British and French approaches to the integration of immigrant populations through the concept of place branding.

L’exploitation du « backlash » contre le multiculturalisme par David Cameron, 2005- 2011.
En 2005, David Cameron est devenu chef du parti conservateur dans un contexte de « backlash » contre le multiculturalisme qu’il a exploité en développant une rhétorique opposant les « blancs » aux « non-blancs ». Il a d’abord non seulement déclaré que le « racisme traditionnel » n’existait plus, mais qu’il s’était renversé : il y aurait dès lors un racisme de la part des minorités ethniques envers les «blancs», cautionné par le multiculturalisme. À partir de là, il a construit un discours de plus en plus violent à l’encontre du multiculturalisme, jusqu’à dénoncer une « doctrine d’État ». Dès 2007, il a utilisé immigration et multiculturalisme comme synonymes afin de renforcer ses attaques contre les « non-blancs » : les emplois, les logements et les ressources naturelles seraient ainsi pris d’assaut par des vagues de travailleurs «étrangers», entraînant une pénurie pour les « Britanniques ».
Ce qui a commencé comme un discours d’opposition s’est transformé en discours de gouvernement lorsqu’il est devenu Premier Ministre en 2010. Cette étude propose d’analyser les étapes de cette évolution discursive afin de comprendre comment David Cameron est parvenu à construire, diffuser et imposer une vision chaotique de l’immigration et du multiculturalisme.

Transcending borders: Navigating migration, identity negotiation, and homeland reinterpretation among Malaysians in the United Kingdom
In the context of the culture of migration, the Malaysian diaspora in the United Kingdom has experienced a proliferation in recent decades. This proliferation is largely attributed to individuals and families seeking new opportunities in education, employment, or lifestyle changes. This study will explore the experiences of the Malaysian diaspora in the United Kingdom, with an emphasis on the complex process of border crossings that these individuals have had to navigate. The act of migration, however, presents its own set of challenges. These encompass the journey of self-transformation, the quest of a sense of belonging, the diasporic reinterpretation of their homeland’s culture, life, and society, along with experiences of discrimination, resulting in the formation of diasporic spaces. In addition, this paper will analyse the emergence of hybrid ethnocultural identities within this transnational diasporic community in multicultural British society. Employing a qualitative approach, the research will gather data through in-depth interviews with first-generation Malaysian immigrants in the United Kingdom. This methodology seeks to offer a comprehensive understanding of the under-researched lived experiences and perspectives of this diaspora. This research aspires to enrich the existing body of knowledge on cultural and diaspora studies by illuminating the processes of identity negotiation and strategies Malaysians use to create and sustain diasporic spaces. By examining these aspects, the research strives to provide valuable insights into the challenges, aspirations, and resilience of this diasporic community.

Helena Francis-Granger is currently pursuing a Ph.D. in British/Malaysian Studies under the supervision of Professor Anne-Marie MOTARD at the University of Paul Valéry-Montpellier 3, and is a fellow member of EMMA research center. Her thesis focuses mainly on migration, identity transformation and cultural hybridity of the Malaysian diaspora in the United Kingdom.

From Borders to Cells: The Evolution of British Immigration Detention, 1970-1989
This research paper delves into the changes in immigration detention practices within the United Kingdom throughout the 1970s and 1980s. It draws extensively from the abundant resources in the National Archives in London. The aim of the study is to uncover and understand the intricate path of immigration detention policies during this transformative era and reveal the socio-political forces that influenced their development.
Through an analysis of official documents, government memoranda, and policy papers, this research examines the origins of new ideologies and institutional frameworks. It unravels the intricate interplay of legislative changes, judicial decisions, and socio-economic factors that shaped the detention landscape.
Moreover, the investigation explores how these policy changes affected the experiences of individuals subjected to immigration detention. Personal narratives found in archival records at times reveal crucial details about the detention system itself as well as providing a poignant understanding of the lived realities during this period.
By synthesising historical data, this research aims to contribute to our understanding of the intricate interplay between evolving policies, societal attitudes, and human rights considerations in the realm of immigration detention in the UK. It underlines the significance of historical context in shaping contemporary perspectives on immigration and detention.

Samuel MALBY est doctorant en 4ème année de thèse à l’université de Toulouse Jean-Jaurès et membre du CAS. Il travaille sur les politiques d’immigration aux États-Unis et au Royaume-Uni. Son sujet de thèse s’intitule : Les politiques de détention à l’égard des migrants au Royaume-Uni et aux États-Unis du tournant des années 1980 à 2010 : une analyse comparative (sous la direction de Vincent Latour, Université Toulouse II Jean Jaurès, et Françoise Coste, Université Toulouse II Jean Jaurès).

Comprehensive sickness insurance or the obscure obstacle to the right for EU citizens to stay in the UK after Brexit. The CSI justice campaign, a grassroots initiative by the3million.
In the aftermath of the 2016 June referendum the right to live in the UK for over 3 million EU citizens seemed compromised. In 2017, an estimated 150,000 EU nationals had to legally qualify for permanent residency in the UK. Surprisingly enough, one of the requirements entailed to have subscribed to Comprehensive Sickness Insurance (CSI) during periods of professional inactivity causing a widespread panic among EU migrant communities. For some EU citizens, CSI became a discriminatory barrier to permanent residency notably for people on low income, students, carers, women, stay-at-home parents, self-sufficient, retired or disabled people. Therefore, it became a battle for pro-European grassroots organisations such as the3million which launched the CSI justice campaign in 2022. This paper aims at discussing the psychological impact and consequences the CSI requirement had on EU citizens who felt anxious and insecure facing challenges and disruption to gain access to their rights. What’s more, we shall try to evaluate to what extent the 3 million campaign participated in clarifying the cumbersome and burdensome process of the permanent residency application but also in condemning the conservative government’s callous approach to immigration and the Home Office’s failure to communicate information about the CSI in the media.

Ethnic Minorities and Brexit: Attitudes, Issues, and Perspectives
The 2016 Brexit referendum crystallized societal divide about identity. The challenges posed by immigration and increasing ethnic diversity were pivotal factors in voters’ choices.[4] While extensive research has examined the behaviour of white voters, ethnic minorities’ attitudes towards the UK’s withdrawal from the European Union and its implications has been little analyzed.[5]
Focusing on British Muslims, this paper has a dual objective: first, to analyse the Muslim population’s stance regarding Brexit and to identify divisive elements within this group. Specifically, I aim to understand why a considerable proportion of Muslims voted for Brexit, despite an anti-European campaign orchestrated by the UK Independence Party (UKIP), which was fundamentally both anti-immigration and anti-Muslim. Second, I attempt to grasp Brexit’s implications for Muslims, particularly in terms of protection against religious discrimination.
Drawing on Sobolewska and Ford’s typology[6], I argue that though an increasing proportion of Muslims feel concerned about immigration issues, much like the ‘social conservatives’, Muslims’ high level of support for the European Union means that they are first and foremost ‘necessity liberals’, supporting the institutions that will best protect their religious rights.
